Workers’ Compensation FAQs

Seeking workers’ compensation can seem difficult. However, it is important to do if you have been injured at work. You deserve to have time to recover without worrying about rushing back to work too soon. As a seasoned workers’ compensation attorney with decades of experience, I am able to help you through the process and make it easier for you. Common questions I receive include:

How do I know if I’m covered?

You should be covered by your employer’s workers’ compensation policy if you meet two conditions: if you are an employee and if you were injured at your place of work. This does not absolutely guarantee that you will receive workers’ compensation, though. The insurance company may argue that you were injured due to your own negligence or that you are exempt from workers’ compensation coverage. That is why it is important to have an attorney on your side, to make your case that you do deserve compensation.

What should I do after I get injured?

It is crucial that you report your injury promptly to your supervisor and your human resources personnel at work. Reporting as soon as possible gives you the best possible chance at receiving adequate compensation. You should go to your usual doctor after your injury, and be sure to keep records of your exam. That will be helpful if it is necessary to go to court.

Can I work at all while receiving workers’ comp?

In Pennsylvania, it depends on your situation. Sometimes, you may only be able to work limited hours a week to continue receiving your workers’ compensation. Often, receiving a job offer from another place of employment can stop your benefits, as it appears to be proof that you are well enough to work. However, your attorney will be able to explain what you should or should not do in your specific case. If you are concerned about handling medical bills, remember that your employer’s insurance should pay them.

Does my type of injury matter?

As long as your injury is bad enough that you are unable to work, it does not. You may receive special compensation for some injuries, such as loss of a finger or limb. However, common workers’ compensation claims also include less drastic injury such as repetitive stress or back problems due to lifting.

Working With You, For You

Workers’ compensation benefits are not a handout. You have earned the right to be covered, and you deserve support during this time.
